Who Is Defending Uniform Interpretation Of The Oregon Public Records Law?

Dear Attorney General John Kroger and Governor Ted Kulongoski:

The Oregon Public Records Law was created by the Oregon legislature with the intent of giving the citizens of Oregon a legal tool to help them keep Oregon's public institutions accountable and their activities transparent. It is enforced by Oregon county District Attorneys and the state's Attorney General. Despite their disparate circumstances these defenders of the Oregon Public Records Law are expected to interpret and enforce the Oregon Public Records Law on a more or less equal basis, giving latitude only at the margins.

In a legal opinion dated March 4, 2010 Multnomah County District Attorney Mike Schrunk established the following criteria related to his interpretation of the Oregon Public Records Law:

1. Requests for any kind of information from any public entity need not be addressed by that public entity unless the words, "Oregon Public Records Law" are included in the request.

2. Oregon District Attorneys may arbitrarily and with prejudice determine which citizens may or may not use email to conduct official business regarding the Oregon Public Records Law.

3. A public entity may withhold information indefinitely by merely refusing to send a letter of denial to the person requesting public documents.

4. Information kept by a public jurisdiction on a computer database is considered, "nonexistent" and cannot be compelled.

Multnomah County District Attorney Mike Schrunk's ignorant, misguided, prejudicial, indeed, perverted, albeit legally binding, interpretation of the legislature's intent is tantamount to a revocation of the Oregon Public Records Law in Multnomah county.

Mayor Sam Adams Betrays His Oath Of Office And North Portland Voters

Portland City Council Testimony 3-10-10

My name is Richard Ellmyer. I am a candidate for the North Portland House seat.

Candidate for city commissioner Sam Adams acknowledged that you can’t make good public policy without good public data. He supported Equitable Distribution of Public Housing.

City commissioner Sam Adams twice asked HAP for statistical data, voted against a HAP nominee who opposed revealing HAP statistical data, supported mayor Potter’s announcement to gather HAP statistical data and, as mayor elect, instructed commissioner Fish to provide him with HAP’s Public Housing statistical data. In EVERY case Sam Adams FAILED to obtain the data and shrugged off the rebuffs to his authority. Adams failure to follow up on any of these efforts demonstrates his disingenuous and dishonest commitment to a public policy of Equitable Distribution of Public Housing.

Mayor Adams has the singular authority to nominate persons to the HAP board. Mayor Adams has never vetted a nominee with regard to the most important policy issue. Do they support Equitable Distribution or UNLIMITED neighborhood concentration of Public Housing? Mayor Adams has instructed his staff not to inform Richard Ellmyer of HAP nominations lest he embarrass the mayor with public testimony challenging the unvetted nominees.

Mult. Co. DA Mike Schrunk Decrees Housing Authority Of Portland ABOVE THE LAW

Multnomah County District Attorney Mike Schrunk has joined the ill fated former Secretary of State, General Colin Powell, in making an end-of-career public pronouncement that exposes him as either a fool or a liar or both. Powell destroyed his credibility by unequivocally asserting the massing of large quantities of weapons of mass destruction in Iraq requiring a march to preemptive war. Schrunk destroyed his credibility by unequivocally asserting that the Housing Authority of Portland is above the law and therefore exempt from the Oregon Public Records Law.

We Americans continue to live with the costs in lives and treasure from Colin Powell's United Nations debacle. Mike Schrunk has now set a legal precedent in Oregon that will seriously diminish the ability of Oregonians to hold their public institutions accountable and in so doing he has provided evidence upon which citizens will rightfully view government with ever increasing cynicism.

Health Data And Public Housing Statistics Related

1 in 18 residents of Multnomah county is a Public Housing client.

1 in 76 residents of Washington county is a Public Housing client.

1 in 84 residents of Clackamas county is a Public Housing client.

PUBLIC HOUSING IS A REGIONAL ISSUE. I have proposed that Metro administer the Housing Authorities of Multnomah, Washington and Clackamas counties under a policy of Equitable Distribution of Public Housing throughout the region. Candidates for public office in these counties need to address this issue in their campaigns.

Mult. Co. Asst. DA John Hoover Petulant After Competence Challenge

In a fit of pique Mult. Co. Asst. DA John Hoover threatened retaliation against a candidate for the North Portland House seat, Richard Ellmyer, because Ellmyer challenged Hoover's competency to professionally judge a public records request from the Housing Authority of Portland (see below).

The North Portland House district has the highest total number and the highest concentration of public housing clients of any district in Oregon. The OVERLOADING of Public housing in North Portland has a significant deleterious affect on public safety, schools, property values, the business climate and the general quality of life. Public housing is a major political issue in North Portland and demands a public conversation between candidates and voters at election time, which is now.

American Federation of Teachers - ON or OFF The Single Payer Bus?

There is no such thing as a little bit pregnant. In America's past you were either for or against equal civil rights for all citizens, for or against a women's right to vote and for or against slavery. It is the same for Single Payer health care reform. You are either for it or against it. However, the American Federation of Teachers is trying to be both, an untenable position.

The AFT passed a resolution supporting Single Payer. The OSEA, Oregon School Employees Association does NOT support Single Payer. And yet, the AFT and the OSEA have united in a joint endorsement process for legislative candidates. With opposing views on the most important and contentious issue on the political agenda, one must ask, How can that be?

A questionnaire was sent to me and all other legislative candidates running in the May 18, 2010 primary. There wasn't a single question asking whether the candidates supported Single Payer? How could that be?

Every question was designed with a self-evident right answer. More of a tutorial than a test. So what is the point of asking? The theme, as in every special interest criteria practiced by Wall Street Banks, Health Insurance Companies etc. is the same, Will you promise to give us more of the limited state/federal resource pie? Business as usual in our American political process.

My question to AFT, why are you in bed with an organization that opposes Single Payer health care reform?

If YOU Don't Hold HAP Accountable Then Who Will?

Hi Portland and Gresham City Councils And Multnomah County Commission:

HAP's director, Steve Rudman, and HAP's board and the mayor of Portland, Sam Adams, have refused to instruct HAP's IT department to:

1. Add a "neighborhood" field to the database that contains client records for the HAP Public Housing Program.

2. Add a "neighborhood" field to the database that contains client records for the HAP Section 8 Housing Voucher Program.

3. Add a "neighborhood" field to the database that contains client records for the HAP New Columbia in North Portland's Portsmouth Neighborhood Program.

4. Gather client data from those administering HAP's 32 properties in Multnomah county under the HAP Affordable Housing Program and import the data into a database that contains a "neighborhood" field.

5. Export the "address" fields from each of the four separate databases mentioned above and send them to Metro for conversion into "neighborhood" fields.

6. Import Metro's conversions into each of the four separate databases mentioned above.

I request that you exercise your authority and responsibility to direct the HAP board members that are supposed to serve the interests of ALL the citizens of your jurisdiction NOT just those that are HAP clients, HAP Staff and HAP benefactors to complete the above request by February 15th.

I also request that you exercise your authority and responsibility to direct the HAP board members that are supposed to serve the interests of ALL the citizens of your jurisdiction NOT just those that are HAP clients, HAP Staff and HAP benefactors to confirm that all HAP's client databases have a "last date modified" field for every record.

These requests are for technical administrative decisions. The cost is virtually nil.

The Housing Authority of Portland is OUT OF CONTROL. It is NOT ACCOUNTABLE to Anyone.

Richard Ellmyer Files For House Seat - Health Care Top Priority

Should a health care bill finally emerge from congress it will not resolve America's/Oregon's moral and economic health care crisis. The battle for health care reform will rage on when the Oregon legislature reconvenes in January 2011. There MUST be at least one strong, loud, fearless voice representing Single Payer interests in our legislature in January 2011. That is the voice of Richard Ellmyer.

If elected to the North Portland House seat I will not only represent my district but ALL Oregonians that support Single Payer health care by:

1. Submitting my single payer Oregon Community Health Care bill, any single payer bill presented to me by a citizen of my district who votes in the May 18, 2010 primary and any single payer bill presented to me by any organization that supports my candidacy.

2. Submitting legislation that would repeal the 2009 legislature's 1% tax on health care premiums.

3. Submitting legislation that would repeal the illegitimate Billion dollar health care bill passed without input from Single Payer advocates.

4. Helping the lobbyists from Portland as well as Lane and Multnomah counties et. al. in their efforts to advance a Single Payer system.

5. Inviting leaders of a Single Payer health care solution to appear as my floor guests as often as possible.

6. Holding meetings, seminars, forums, town halls and whatever else can be done to bring Single Payer health care leaders and supporters to the state capitol for public conversations and debate.

7. Guiding whatever federal mandates on Oregon may emerge from a congressional health care bill towards a single payer solution.

Ellmyer Confronts Portland City Council Over Coverups Of Bad Policy, Disrespect And Incompetence

My name is Richard Ellmyer. I am a candidate for the North Portland House seat in the May Democratic Primary. On December 28 I sent you a request for Public Housing Statistical Data which I mentioned was intended to be used as a basis for discussion with voters during my campaign for public office. Despite my admonition that time was of the essence for 37 days of my campaign you have not provided me or the voters with any one of the four separate reports I requested.

Here are some facts for the record:

All of you accept mayor Adams’ indefensible, foolish and slightly nutty assertion that there is NO PUBLIC housing in Portland only affordable housing.

All of you oppose requiring public documents to use the term, "public housing" when the subject matter of the document refers to programs and policies where the following conditions are met: Public Housing = Means Test + Government Subsidy + Rental Agreement.

All of you support mayor Adams’ policy of UNLIMITED neighborhood concentration of public housing.

Ellmyer Challenges Metro To Run Regional Public Housing Agencies

My name is Richard Ellmyer. I am a candidate for the North Portland House seat in the May Democratic Primary. Gretchen Kafoury,  who was on the legislative committee that wrote the original Metro charter, recently reminded me that public housing was included as a regional issue but somehow fell off Metro’s agenda. I am here today to request your support for putting it back on.

Public Housing is a regional issue. ALL Public Housing is controlled by government. All Public Housing agencies in Multnomah, Clackamas and Washington counties should be under the control of the Metro Regional Government following a policy of Equitable Distribution of Public Housing throughout the region.
